Intended for family law professionals, this handbook reviews adoption law in the United States. Following an introductory chapter on the different parties to an adoption and the different types of adoption, Chapter 2 explains best practices for client intake, providing advice, and consultations. Information is provided on dealing with client preferences for the adoption, sample questions regarding preference, ways to avoid scams, and the confidentiality of client files. Chapter 3 addresses the home study process and requirements, and Chapter 4 delves into requirements and best practices for representing adoptive and birth parents in domestic private agency adoptions. Chapters 5 and 6 discuss requirements relevant to public agency adoptions and independent adoptions. Following chapters explain: the Interstate Compact on Placement of Children (ICPC), the rights of biological fathers and legal representation for birth fathers, consent, relinquishment, and termination of parental rights, second-parent or co-parent adoptions, Post-Adoption Contact Agreements (PACA), the Indian Child Welfare Act, stepparent adoptions, the cost and financing of adoptions, adult adoption, open adoption records, and adoption disruption. Chapter 18 reviews legal decisions and requirements relating to the failure of disclosure and tort of wrongful adoption. Types of wrongful adoption cases, disclosure requirements, and questions to ask at intake of a wrongful adoption case are discussed. The final chapter addresses intercountry or international adoptions. Appendices include relevant adoption forms, instructions for completing ICPC materials, a putative father registry chart, sample consent forms, and additional resource. Numerous references.
